Like every other company, we have some ground rules and detailed Policies/Terms and Conditions to ensure we continue to create the best community possible.
We know it’s a long page, that’s because it’s broken up into chunks that detail different aspects of the BDY service. Essentially, what it says is that we do our best to provide you with a great service, governed by reasonable rules and expectations.
Please read these Policies/Terms & Conditions carefully before using www.bdystudios.com (“the Site) and or one of our locations (“the Studio”) operated by PTK FITNESS, LLC DBA BDY (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the site at www.bdystudios.com.

Privacy Policy
Your privacy is very important to us. Any personal information you choose to give us will only be used to help us provide you with the highest quality services, products, and support. We will never share your personal or financial information with any other party. We do not share bank or credit card information with any outside parties.
Release of Liability
You are participating in the Classes, Health Programs and Workshops (hereinafter, “classes”) offered by BDY (“Studio”) and its instructors. You recognize that participation in these classes requires physical exertion that may be strenuous and may cause physical injury, and you are fully aware of the risks and hazards involved, including, but not limited to, cuts, scratches, bruises, joint and muscular injuries, heart attack and death. You understand that it is your responsibility to consult with a physician prior to and regarding your participation in the classes offered at Studio and you have no medical condition that would prevent your full participation in said classes. Studio makes no claims as to medical or fitness results that can or may be obtained through use of the Studio’s facilities, equipment or services. You agree to indemnify, defend and hold harmless Studio, its officers, directors, employees, agents, representatives and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the site or services, any user postings made by you, your violation of any terms and conditions or policies or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. You assume full responsibility for any risks, injuries or damages which you might incur as a result of participating in the classes and expressly waive any claim, action, suit, procedure, expense, damages and any and all liability you may incur or have against Studio, its officers, directors, instructors, employees, agents, representatives and third parties for injury or damages that you may sustain as a result of participating in the classes. You acknowledge that you have been urged to avoid bringing valuables into the Facilities and that BDY shall not be liable for the loss of, theft of, or damage to your personal property, including items left in bathrooms, studios, or anywhere else in the Facilities. You acknowledge that no portion of any fees paid by you is in consideration for the safeguarding of valuables. If you are participating in our online classes, you acknowledge that you are not being monitored by any instructor and that there is no liability to the instructor, employees, Studio, its agents and/or representatives if there is an injury sustained. You consent to be photographed/recorded for use by the studio in social media/marketing and promotional materials, and that all such materials are the property of the Studio. You also provide this photographic/recording consent for any minors for whom you are signing on this consent. As a member, you understand that you are required to provide 30 days written notice to info@bdystudios.com in order to cancel your membership. You affirm that you are over 18 years of age, or are the parent or legal guardian of the person you are registering. By entering BDY facilities, you are aware and you agree to fully accept all known and unknown risks, including the potential risk of exposure to respiratory illnesses such as the coronavirus (COVID-19). Although we regularly sanitize our equipment and use recommended cleaning methods, you understand that you may be exposed to the coronavirus or its symptoms through no fault of our own. You understand and agree that you will hold BDY harmless for any real or perceived symptoms, disease, illness, or injuries related to COVID-19 or any exacerbation of any existing symptoms, disease, illness or injuries related to COVID-19 and you fully agree to accept all risks of entering the facilities, using the equipment, working with staff, attending classes, and/or interacting or being exposed to other members.
Cancellations and Refunds
If you need to cancel a class for any reason, you may do so up until 4 hours before class begins on the app or by messaging (304) 244-3125. Members cancelling with less than 4 hours notice will be charged a $10 cancellation fee. Class pass holders will have a class removed from their pass. Those who simply don’t come to class will be assessed a $20 no-show fee. Staff are not responsible for scheduling your classes or absolving late cancels. All fees are non-refundable once charged.
Class Passes are for you only and can’t be refunded, extended, shared, or transferred to someone else. They are subject to limits of time. Always check your expiration date before and after your purchase.
Gift Cards are not refundable or returnable. If purchased for a specific pass, they can not be used as cash. If you wish to return an item, you may do so for BDY credit or exchange within 7 days of purchase. Sale items are final sale and may not be returned or exchanged.
Automatic membership payments are not refundable after they’ve been processed. Memberships are non-transferable to another person. Memberships may be cancelled with 30 days written notice to info@bdystudios.com prior to your credit/debit card processing date to cancel your monthly recurring membership. If you cancel in the middle of your billing cycle, your membership will be cancelled after the next billing cycle. All cancellation requests must be sent to info@bdystudios.com. Cancellation requests submitted within the 30-day billing cycle will result in a final payment drawn from your account on your established auto draft date. Once the final payment has been drawn from your account, you will have 30 days from the last bill date to attend classes. It is your responsibility to submit the cancellation request form 30 days in advance of your next bill date. There will be no refund issued once a payment has been charged to your credit/debit card. All prepaid memberships are nonrefundable. You may suspend your membership for a minimum of 14 days and a maximum of 60 days per year, 1 time per year. Fees (including but not limited to: suspension fees, cancellation fees, no show fees, or initiation fees) are nonrefundable.
We do not offer refunds on purchases for our services. For branded BDY retail items, BDY will accept items (excluding food and drink) for exchange or account credit only. Any exchanged item must be returned in its original unaltered condition, and all tags intact, within 3 days of purchase. No returns are accepted on sale items. Workshop and/or event cancellations require a 48 hour email notice before the workshop takes place. Cancellation requests within less than 48 hours notice will not be honored unless we can fill your space. All refunds will incur a 20% administration fee, or you can get a full refund credited to your BDY account to be used toward any future purchase. Workshop cancellation requests must be requested by email to info@bdystudios.com. Absence from a workshop or event is non-refundable. Workshops and events may occasionally be canceled by the studio. If your event is canceled you will be notified by email, and you will receive a full refund or full credit toward your BDY account according to your preference. BDY in its sole discretion, may revoke student’s class, class pass or membership, at any time without refund, in the event the student engages in behavior that is unsafe or objectionable to other participants or staff, or for reasons of nuisance, disturbance to other participants or staff, moral turpitude or fraud, or personal hygiene, and/or attire.
Studio Maximum Capacity
BDY is fortunate to have a large practice space in which classes are held. However, there is a limit to how many people can comfortably fit in each class. Once this number of people is registered for class, we ask additional students to return to take a different class. Registering online is recommended to save your spot.
Please do not place yourself on multiple waitlists on the same day. If you are confirmed to multiple classes from multiple waitlists at the same time, it will count as a "late cancel" (or a class from a class pass or single class purchased) for the class you decide against taking. Additionally, it keeps someone else from taking a spot in that class. We understand your reason for signing up for multiple waitlists, but ask that you only select one class per day that aligns best with your schedule and commit to it.
Latecomers
We recommend that you arrive 10 minutes before class starts. The door will be locked at the beginning of class, and students will not be allowed to enter after the door is locked. Please do not knock on the door as that will disturb others in the class.
Lost Items
BDY will not be responsible for lost or stolen items under any circumstances. Please refrain from bringing valuables into the studio. The studio provides a Lost and Found basket for items students may leave behind. On the first day of each month these items, including yoga mats, will be removed and donated or disposed of.
Inclement Weather/Schedule Changes
In an effort to keep everyone safe during inclement weather, we cancel classes from time to time. For updates on class cancellations or holiday class schedules, please check our online schedule and Facebook Page. We reserve the right to cancel classes based on low registration. As a result of repair, maintenance, special occasions, or act of God, the Studio may be required to restrict the use or temporarily close its facilities or activities from time to time, and certain facilities, events, services or programs may be added or eliminated from time to time, at the Studio’s discretion.
Childcare
We do not currently offer childcare in our studios. We welcome students ages 14 and up. Students under the age of 16 must be accompanied in class by an adult, and a parent or guardian must sign a release for any student under the age of 18.
Walk-ins
If you can reserve a class online, please do. It will help our staff greatly with the sign-in process and make things faster for you, as well. If a class is full or waitlisted, we can not guarantee a walk-in a spot in that class.
Studio Hours
Doors to the studios are opened within 10 minutes before class time. We promptly lock the studio door at the start of class for the safety of students and their possessions.
The retail shop is open M-Th from 4-7 p.m., and Saturdays from 8 a.m.-12 p.m.
Preparing for Class
Students strongly advised to consult with his/her physician or to have a physical examination before using any of the Studio’s facilities or enrolling in any of the Studio’s classes.
For all classes, students must be at least 14 years old. Additionally, students under 16 must have a parent present.* For Cycle classes, riders must be at least 4'11".
No shoes are worn during Yoga or Barre classes. Please take your shoes off at the door and leave them in the shoe cubby. Appropriate athletic attire is required. BDY reserves the right to make the final determination in its sole discretion with regard to appropriate attire.
Students are encouraged to arrive early prior to their first class as well as request ongoing support from studio staff to ensure the proper and safe use of studio equipment.
Shoes are worn, however, in Cycle, Fusion and Combo classes, and many students wear barre socks in barre classes. We encourage you to use cycling shoes as they tend to create a better experience for the rider.
Please refrain from wearing heavily scented lotions and perfumes to class. Likewise, please practice "saucha" (cleanliness) by showering and keeping your clothes, shoes, and mat clean between classes. Personal hygiene is appreciated as we are often practicing (and sweating) in close proximity to each other.
*Please note, if you are under 18, your parent or guardian will need to sign a waiver in person.
